These Terms of Service ("Terms") govern your access to and use of doximagen.com (the "Site") and any managed IT, cybersecurity, or cloud hosting services provided by Doximagen LLC ("Doximagen", "we", "us", or "our"). By using the Site, you agree to these Terms.
1. Use of the Site
You may use the Site for lawful purposes only. You agree not to misuse the Site, attempt to gain unauthorized access, interfere with its operation, or scrape content in ways that violate applicable law or these Terms.
2. Services agreement
Information on the Site is provided for general purposes and does not constitute a binding offer. Managed IT services are governed by a separate written Master Services Agreement (MSA) and applicable Statements of Work (SOWs) signed between Doximagen and the client. In any conflict, the MSA controls over these Terms.
3. Intellectual property
All content on the Site — including text, graphics, logos, and code — is owned by or licensed to Doximagen and protected by intellectual property laws. You may view and share links to the Site for personal or business reference; any other use requires prior written permission.
4. Acceptable use
- Do not transmit malware, attempt intrusion, or probe our systems without authorization.
- Do not submit false, misleading, or abusive content through forms or email.
- Do not use the Site to violate the privacy or rights of any person or entity.
- Authorized security testing requires a signed engagement letter.
5. Third-party links and services
The Site may link to third-party sites or reference third-party tools we use to deliver services. We are not responsible for the content, policies, or practices of third parties.
6. Disclaimers
The Site is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Service-level commitments, if any, are defined exclusively in your signed MSA/SOW.
7. Limitation of liability
To the maximum extent permitted by law, Doximagen and its officers, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Site. Our total liability relating to the Site is limited to one hundred U.S. dollars (USD $100). Liability for paid services is governed by your MSA.
8. Indemnification
You agree to indemnify and hold harmless Doximagen from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Site or breach of these Terms.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
10. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to personal jurisdiction there.
